Our purpose is to help people give access to opening job opportunities at Yoma Fleet Limited. We believe it is important that you understand how your information is collected, used, protected and how you can manage it when you engage with us. Our Privacy Policy explains all of this in detail below.
By registering and creating an account with us, using our products and services, visiting our Platforms or simply engaging with us over the phone, via email, in person or by any other means, the terms contained in this Privacy Policy will apply to you.

Personal Information

We collect different types of information about you depending on how you interact with us and use our products and services.

For example: To sign up as a Registered User on our Platforms, you will need to provide basic information such as your name and email address. If you are a Candidate, if you choose to create a Profile and/or if you are applying for a job, we may collect additional Personal Information about you.

The main types of information (including Personal Information) we may collect includes but is not limited to:

a. If you are a Registered User:

General Data

For all Registered Users: name, email address and password.

For Candidates setting up a Profile, you may elect to disclose to us the following information: country of residence (including Home Location, preferred work locations), resumes, licences and certifications (e.g., driver's licence expiry date), and any other Personal Information which a Candidate may provide in their resume uploaded to our Platforms or otherwise included in the Candidate's Profile on our Platforms.

For Candidates applying for a job, we may collect additional Personal Information from you, such as any Personal Information that you may include within a resume, cover letters or in response to role requirement questions or selection criteria.

Contact Data

Email address, mobile phone number, other contact number, home address, contact address, company details (if applicable).

Google or Facebook logins or Apple ID (Linked Accounts).

Other contact data that a User may share with us.

Background Data

For Candidates setting up a Profile, you may elect to disclose to us the following information: personal summary, work experience, educational background, language skills, other skills, professional qualifications, salary information, preferred job classifications and locations.

Usage and Device Data

Information on access and visits to a Platform, usage patterns, Cookies, pages which you have visited, search and click history on a Platform, personalization of content on a Platform, IP Address, browser types and forms, referrer page, operating system, date and time stamps and clickstream data retained in log files.

This data is automatically collected through use of Cookies that is part of or placed on your browser or on your devices.

Third Party Data (including Personal Information of Related Person)

Name, email address, mobile phone number, other contact number, contact address, workplace, position, relationship with the Registered User (please ensure you have the consent of the relevant third party when disclosing their Personal Information to us).

Location Data

Home address, contact address and/or device location when using a Platform on your device. Your device location is only stored on your device and only if you have given your permission for the application to identify your location.

b. If you are an Unregistered User:

We may collect your Usage and Device Data, Contact Data and/or Location Data if you engage with us as an Unregistered User. For example, if you contact us via phone, email or online.

Other categories of Personal Information:
We may also collect other Personal Information that you provide through your engagement with us, for example, in connection with surveys or questionnaire.

Use of Personal Information

By submitting your information to us, you have given us consent in the use of your personal information detailed in this section.

We collect Personal Information from you which we have a legal basis to collect and is necessary for the purposes set out below:

a. To provide Users with the job application process
b. Meet our regulatory, compliance, and legal obligations
c. We will share your information with our recruiting team, our Human Resources department, and Yoma Group Human Resources Department to process your job application.
d. We may contact your past employers and/or reference personnel for a background check and your employment history verification.

Additional Terms applicable to Candidate

a. If you are a Candidate, this section applies to you.
b. We hereby grant you a limited, terminable, non-exclusive right to access and use our websites and apps only for your personal use seeking employment opportunities for yourself. This authorizes you to view and download a single copy of the Content or material on our websites and apps solely for your personal, non-commercial use.
c. When you register with any of our websites and apps, you will be asked to create an account and provide us with certain information including a valid email address.
d. Any Profile you submit must be accurate, complete, up to date and not misleading. The Profile requires standard fields to be completed by you. You may not impersonate another person, living or dead.
e. You acknowledge and agree that you are solely responsible for the form, content and accuracy of any Profile and resume or material contained therein placed by you on our websites and apps.
f. You acknowledge and agree that you are solely responsible for any consequences arising from the creation of your account and the use of our websites and apps.
g. We reserve the right to offer third party services and products to you based on the preferences that you identify in your registration (or any time thereafter) or where you have agreed to receive such offers.
h. You understand and acknowledge that all information provided by you, your Profile, resume, and/or other account information shall be disclosed to your past Employers when you apply for a role.
i. You understand and acknowledge that you have no ownership rights in your account and that if you cancel your account or your account is terminated, all your account information, including your Profile, resumes, cover letters, saved jobs, will be marked as deleted in and may be deleted from our Databases and will be removed from any public area of our websites and apps. Information may continue to be available for some period of time because of delays in propagating such deletion through our web servers.
j. We reserve the right to delete your account and all of your information after a significant duration of inactivity.
k. We give no guarantee to you of the continued availability of any particolar job advertised on our website and will not be liable to you should we have filled the vacancy at any time prior to removal of the advertisement from our website.

User Content and Submissions

a. You understand that all User Content is the sole responsibility of the person from which such User Content originated.
b. You understand and acknowledge that all information provided by you, your Profile, resume, and/or account information shall be stored in our Databases.
c. You understand, acknowledge and consent that all information provided by you, your Profile, resume, and/or account information may be transferred to countries outside of your location for the purposes of storing and/or processing. Please see our Privacy Policy for further details.
d. By submitting, posting or displaying User Content on or through our website, you grant us, subject to your privacy setting and applicable laws, a worldwide, non-exclusive, royalty-free license to reproduce, adapt, distribute and publish such User Content through our websites and apps. We will discontinue this licensed use within a commercially reasonable period after such User Content is removed from our websites and apps. We reserve the right to refuse to accept, post, display or transmit any User Content in our sole discretion.
e. If you post User Content in any public area of any of our websites and apps, you also permit any User to access, view, store and reproduce such User Content for personal use.
f. We may review and remove any User Content that, in our sole judgment, violates these Terms, violates applicable laws, rules or regulations, is abusive, disruptive, offensive or illegal, or violates the rights of, or harms or threatens the safety of, Users of any of our websites and apps. We reserve the right to expel Users and prevent their further access to our websites and apps and/or use of our Services for violating the Terms or applicable laws, rules or regulations. We may take any action with respect to User Content that we deem necessary or appropriate in our sole discretion if we believe that such User Content could create liability for us, damage our brand or public image, or cause us to lose Users.
g. We do not represent or guarantee the truthfulness, accuracy, or reliability of User Content, derivative works from User Content, or any other communications posted by Users nor do we endorse any opinions expressed by Users. You acknowledge that any reliance on material posted by other Users will be at your own risk.

Right to suspend or cancel your account registration

a. We may suspend or cancel your Candidate account registration immediately at our reasonable discretion or if you breach any of your obligations under these Terms.
b. You can cancel your Candidate account registration at any time.
c. The suspension or cancellation of your Candidate account registration and your right to use our websites and apps shall not affect either party's statutory rights or liabilities.

Term and Termination

a. These Terms will remain in full force and effect while you are a User of any of our websites and apps.
b. We reserve the right, at our sole discretion, to pursue all of our legal remedies, if you breach these Terms. This may include, but is not limited to:
- removal of your User Content from our websites and apps;
- immediate termination of your Candidate account registration;
- removing or restricting your access to our websites and apps and/or any of our Services.
c. Even after you are no longer a User of our websites and apps, provisions of these Terms that are capable of surviving will remain in effect.

Disclaimers

a. We shall not be liable for any loss of information howsoever caused as a result of any interruption, suspension or termination of our Services or for Content, accuracy or quality of information available or transmitted through our Services.
b. You acknowledge and agree that it is not our policy to exercise editorial control over and to edit or amend any data or contents of any emails or posting or any information that may be inserted or made available or transmitted to or from a third party in or through our websites and apps and/or our Services.

Indemnity

a. To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless QaasT Limited and the Yoma Group and its affiliates, and their respective officers, directors, employees, and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from:
- Any User Content or other material you provide to any of our websites and apps;
- Your use of any Content; or
- Your breach of these Terms.
b. We shall provide notice to you promptly of any such claim, suit or proceeding

Contracting Parties and Governing Law

a. Your contractual relationship is with QaasT Limited.
b. These Terms are governed by the laws of the Republic of the Union of Myanmar. Each party irrevocably and unconditionally submits to the exclusive jurisdiction of the courts of the Republic of the Union of Myanmar.
c. QaasT Limited reserves the right to assign or novate these Terms (or any aspect of these Terms) to any member of QaasT Limited and the Yoma Group without your consent.

Miscellaneous

a. You may not transfer any of your rights or obligations under these Terms to any other person. We may transfer our rights or obligations under these Terms to another business where we reasonably believe your rights will not be materially affected.
b. If you breach these Terms and we do not act, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach the Terms.
c. We shall not be responsible for any breach of these Terms caused by circumstances beyond our reasonable control.
d. If any of these Terms shall be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, the invalidity or unenforceability of such provision shall not affect the other provisions of these Terms and all provision not affected by such invalidity or unenforceability shall remain in full force and effect.
e. Any member of QaasT Limited and the Yoma Group may assist in providing the relevant products and services to you.
